Nolan is a litigator whose practice focuses on matters that have complex computer technology-related issues, including patent and trade secret litigation, commercial disputes, and cyber-incident response and planning. He also advises clients on electronic discovery issues, with a particular focus on digital forensics, managing conflicts between U.S. discovery requirements and foreign privacy laws; and assisting organizations in developing and implementing strategies and information management systems to reduce discovery costs and decrease compliance risks. Nolan has worked on a number of data breach responses, varying in size and complexity from the breach of a single e-mail account due to a successful phishing attack to a large-scale multi-million-record data breach involving regulatory investigations, congressional inquiries, and class action lawsuits. Nolan has also assisted companies with privileged "gap analysis," analyzing an organization's security posture against industry norms in anticipation of potential legal actions with the goal of improving security and reducing legal exposure. Nolan is also a frequent author and speaker on intellectual property concerns, e-discovery, and the legal impact of emerging technologies, such as cloud computing and big data.
